Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the SnapFix mobile application or website (collectively, the "Service") operated by SnapFix Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to all of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and SnapFix Inc. We recommend printing or saving a copy for your records.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

• You are 18 years of age or older;
• You have the legal capacity to enter into binding contracts;
• You are not prohibited from using the Service under applicable law.

If you are accessing the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Description of Service

SnapFix provides:

• AI-assisted diagnosis of home repair and maintenance issues based on photos and text descriptions you submit;
• A directory of independent contractors in the Kitchener-Waterloo region of Ontario, Canada;
• Tools for homeowners, tenants, and landlords to submit, track, and manage repair requests;
• Optional subscription features including enhanced diagnosis capabilities and priority support.

4. User Accounts

You must create an account to use most features of the Service. You agree to:

• Provide accurate, current, and complete registration information;
• Maintain and promptly update your information;
• Keep your password confidential and not share your account credentials;
• Notify us immediately at support@snapfix.app if you suspect unauthorized access to your account;
• Accept responsibility for all activity that occurs under your account.

We reserve the right to disable or terminate any account at our discretion, including for inactivity or suspected violations of these Terms.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription ("Pro" at $4.99 CAD/month or $49.99 CAD/year, and "Premium" at $12.99 CAD/month or $129.99 CAD/year). All subscriptions are processed through Apple's App Store and are subject to Apple's payment terms and refund policies.

• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You can manage and cancel subscriptions at any time through your Apple ID account settings (Settings → Apple ID → Subscriptions).
• Refunds: Refund requests are handled exclusively by Apple. We do not process refunds directly.
• Price changes: We will provide advance notice of any price changes before your next renewal.

A free tier is available with limited features. We reserve the right to modify the features included in each tier at any time with reasonable notice.

6. AI Diagnosis Disclaimer

AI-generated results may be inaccurate, incomplete, or inapplicable to your specific situation. You should always:

• Consult a licensed professional before undertaking any repair;
• Never rely solely on an AI diagnosis where safety is a concern;
• Immediately contact emergency services (911) for gas leaks, electrical fires, flooding, or structural collapse.

SnapFix expressly disclaims all liability for personal injury, property damage, financial loss, or any other harm arising from reliance on AI-generated diagnoses.

7. Contractor Directory

Contractors listed in the Service are independent third parties. SnapFix does not:

• Verify contractor licenses, insurance, bonding, or professional credentials;
• Guarantee the quality, safety, timeliness, or legality of any contractor's work;
• Act as a general contractor, employer, or agent of any contractor.

Before hiring any contractor, you are solely responsible for independently confirming that the contractor is properly licensed, bonded, and insured in Ontario. The Ontario College of Trades (collegeoftrades.ca) is a resource for verifying trade credentials.

8. User Content

By submitting photos, descriptions, reviews, or other content ("User Content") to the Service, you:

• Grant SnapFix a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely to provide and improve the Service;
• Represent that you own or have the right to submit the content;
• Represent that the content does not violate any third-party rights, privacy rights, or applicable laws;
• Retain full ownership of your content.

We do not use User Content for advertising or sell it to third parties.

9. Prohibited Conduct

You agree not to use the Service to:

• Submit false, misleading, or fraudulent information;
• Impersonate any person, entity, or contractor;
• Engage in any unlawful activity;
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure;
• Reverse-engineer, decompile, disassemble, or create derivative works of the App;
• Upload or transmit malware, viruses, or harmful code;
• Harass, abuse, defame, or threaten other users or contractors;
• Send unsolicited commercial messages (spam) to other users;
• Scrape, crawl, or collect data from the Service without authorization;
• Interfere with or disrupt the integrity or performance of the Service.

10. Intellectual Property

The Service and all its content, features, and functionality — including text, graphics, logos, icons, images, audio clips, and software — are the exclusive property of SnapFix Inc. and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of the Service without our express prior written permission.

12. Limitation of Liability

Our total aggregate liability to you for any and all claims arising from these Terms or your use of the Service shall not exceed the greater of: (a) the total amount you paid us in the twelve (12) months preceding the claim, or (b) fifty Canadian dollars (CAD $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless SnapFix Inc. and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of or access to the Service;
• Your violation of these Terms;
• Your violation of any third-party rights, including intellectual property or privacy rights;
• Any User Content you submit to the Service;
• Any dispute between you and a contractor found through the Service.

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Conduct that violates these Terms;
• Conduct harmful to other users, contractors, or third parties;
• Extended inactivity;
• Any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 10, 11, 12, 13, and 15) shall continue in full force.

You may delete your account at any time from within the App or by contacting us at support@snapfix.app.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in the Regional Municipality of Waterloo, Ontario, Canada. You consent to the personal jurisdiction of such courts.

Notwithstanding the above, SnapFix reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Sending an email to your registered address, and/or
• Displaying a prominent notice in the App

Changes take effect 14 days after notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
